EBA's Joint Board rules on NOVIS-EIOPA appeal costs

The European Banking Authority (EBA) announced that the ESAs’ Joint Board of Appeal has issued its decision on the reimbursement of costs in an appeal brought by NOVIS Insurance Company against the European Insurance and Occupational Pensions Authority (EIOPA). The Board confirmed its competence to decide on cost allocation and ruled on the total amount to be reimbursed by EIOPA.

The contested reimbursement

In a July 30, 2024 decision, the Board had ordered EIOPA to reimburse NOVIS' appeal costs.

EIOPA subsequently contested the breakdown of costs, leading the matter back to the Board for a final ruling on the amounts.

Clarifying cost principles

The Board's December 3, 2025 decision confirmed its competence to allocate and tax costs.

It clarified that only objectively necessary and reasonable costs are eligible.

A final ruling on the total amount EIOPA must reimburse was then issued.
