Four consultations launch to strengthen EU depositor protection

The European Banking Authority has launched four public consultations on proposed rules to strengthen depositor protection across the EU. Stakeholders have until October 23, 2026, to submit comments on the new standards.

Standardising protection across the EU

The European Banking Authority (EBA) has initiated four public consultations under the revised Deposit Guarantee Schemes Directive.

The proposals encompass Implementing Technical Standards on depositor information and information exchange, Regulatory Technical Standards on client funds, and Guidelines on investment strategies.

The framework aims to harmonise communication standards during bank mergers or failures, improve transparency on available financial means, and standardise procedures for identifying and reimbursing clients with intermediary accounts.

These measures ensure consistent protection, operational efficiency, and legal certainty across all Member States.

From crisis management to smart investing

The draft guidelines also dictate how Deposit Guarantee Schemes should invest collected funds to maintain diversification, low risk, and sufficient liquidity.

Under DGSD3, funds can be rapidly mobilised not only for depositor reimbursement, but also for resolution and intervention mandates.

Public hearings are scheduled for September 24, 2026, with the consultation period closing on October 23, 2026.

The EBA is mandated to develop twelve technical standards under the revised directive.

Harmonisation with administrative teeth

The proposals finally bridge persistent gaps in cross-border depositor reimbursement.

However, the mandatory implementation of four separate standards will significantly strain bank compliance departments.

Whether smaller institutions can absorb these operational costs without reducing lending remains highly questionable.
